JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner is languishing in custody since 13.08.2013 in connection with Mithanpura P.S. Case No. 34 of 2011 for the offences instituted under Sections 395 and 397 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the informant is watchman of Sheopujan Singh and on 13.02.2011 in the night 4-5 miscreants came to the house of Sheopujan Singh and looted the articles worth Rs. 20,000/- from the house as well as his mobile phone and cash Rs. 340/.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.08.2013 and the charge sheet has been submitted in the present case. It has further been submitted
Patna High Court Cr.Misc. No.26049 of 2015 (2) dt.24-07-2015 2/2 that the petitioner is not named in the F.I.R. nor he has been put on T.I.P.
On behalf of the State it has been submitted that the petitioner's name had come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge, Muzaffarpur, in connection with S.T. No. 223 of 2014, arising out of Mithanpur P.S. Case No. 34 of 2011. U.K./- (Sudhir Singh, J) U T
