Heard the parties.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Section 396 of the Indian Penal Code.

According to F.I.R., unknown miscreants robbed the informant and caused fire arm injury and death of the pillion rider on the motorcycle of the informant.

Learned counsel for the petitioners submits that during investigation co-accused Dharamraj was arrested and he

Patna High Court CR. MISC. No.3672 of 2020(3) dt.18-09-2020 2/2 confessed his involvement in the crime alleged. He further stated that the petitioners were also along with him. Dharamraj further admitted that he was the person who had fired at the deceased. Learned counsel for the petitioners further submits that besides aforesaid, there is no other material against the petitioners.

In my view, police interrogation and T.I. parade of the petitioners would be required in this case. Hence petitioners do not deserve prayer for anticipatory bail.

Hence, prayer for anticipatory bail of the petitioners is refused in connection with Nalanda P.S. Case No. 20 of 2019 pending in the Court of learned Chief Judicial Magistrate, Nalanda.

The petitioners may surrender and pray for regular bail.
