====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 16-02-2022 Heard learned counsel for the petitioner and learned APP for the State.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 34 of the Indian Penal Code. The prosecution case as per F.I.R is that the petitioner in connivance with other accused persons

No.15965 of 2021(3) dt.16-02-2022 2/3 published a forged advertisement for filling up the vacancies of Block Coordinator and Village Teacher and took Rs. 3500/- and Rs. 2500/- from the informant and others for providing employment but neither employment was provided nor money has been returned. It is submitted by learned counsel for the petitioner that petitioner is only an employee of a registered NGO namely Deo Shivam Evam Samaj Kalyan Society. The advertisements were published through a fake websites and petitioner's NGO never advertise any such vacancy. Moreover, other co-accused persons have been granted bail by a coordinate Bench of this Court vide order dated 29.05.2020 passed in Cr. Misc. No. 6610 of 2020.

Considering the aforestated facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)

No.15965 of 2021(3) dt.16-02-2022 3/3 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Purnea Sadar P.S. Case No. 628 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
