Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 366-A/34 of the Indian Penal Code.

The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she stated that when she was kidnapped by other accused, petitioner was also present there but subsequently, she was taken to an unknown place where she was raped by co-accused, Ranjit Sada and Anmol Yadav. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.17516 of 2016 (2) dt.29-04-2016 2/2 except the aforesaid material, there appears to be nothing against the petitioner and moreover, petitioner happens to be full brother of co-accused, Ranjit Sada and is languishing in jail custody since 21.01.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 410 of 2015.
