The petitioner seeks regular bail in connection with Desari P.S. Case No. 254 of 2018 registered for the offence punishable under Sections 342, 323, 324, 325, 307, 379, 354(B), 452, 504, 506/34 of the Indian Penal Code.

The allegation is regarding the accused persons having assaulted the informant and it is further alleged that they had torn her blouse. The informant has also alleged that though gun shot firing was made but the gun shot missed her and she was saved by her luck.

The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated after two days of the incident when he was getting his family

Patna High Court Cr.Misc. No.3075 of 2019(3) dt.08-02-2019 2/2 members treated in the hospital. It is submitted that though the petitioner is having a bad antecedent but he is on bail in all the cases. The petitioner is stated to be languishing in custody since 24.09.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Desari P.S. Case No. 254 of 2018.
