The petitioner seeks bail in NH Bangra P.S. Case No. 114 of 2021, registered for the offence punishable punishable under Sections 272, 273, 467, 468, 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016. 2142 litres of Indian made foreign liquor has been recovered from one Container of which this petitioner was driver.
It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner was simply driving the vehicle and was not aware about the nature of consignment. Petitioner has no concern with the seized liquor. Petitioner is in custody since 24.10.2021 having no criminal
