JUSTICE SHIVAJI PANDEY ORAL ORDER 28-05-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing in view of the lock-down on account of COVID-19 pandemic.

In this case, the petitioner is seeking regular bail in connection with Nawanagar P.S. Case No.146 of 2019 registered for offence punishable under sections 363, 365/34 of the Indian Penal Code.

In the present case, allegation has been made that the present petitioner has kidnapped the daughter of informant with illegal motive. In the statement recorded under section 164 P.C., the daughter of informant has stated that the present petitioner, Mr. Piyush Choudhary had assured that he will drop her along with her friend to the school but it happened that he dropped her friend and took the daughter of informant to Bikramganj and

Patna High Court CR. MISC. No.3681 of 2020(3) dt.28-05-2020 2/2 where he tried to commit sexual assault but he failed, whereafter, he dropped her to Ara Railway Station and later on, she went to her friend and remained there for one month. Learned counsel for the petitioner submits that there is no such allegation of commission of ravaging modesty and the petitioner is in jail since 27.11.2019.

Looking to the entire facts and circumstances of the case, the petitioner, named above, is directed to be released on regular bail on his personal bond to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No.146 of 2019, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. In case of failure, the bail granted to the petitioner will be treated to have been withdrawn.
