The petitioners apprehend their arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, on the alleged date and time of occurrence, cousin brother of informant was constructing house on the land of informant to which informant made protest. Thereafter, all the FIR named accused persons including petitioners armed with Farsa, Bhala attacked on the informant and when father of informant came to save him, these petitioners and co-accused Ram Das Yadav gave Farsa blow
Patna High Court CR. MISC. No.8849 of 2023(3) dt.15-05-2023 2/2 and Bhala blow, as a result of which he sustained injuries. It is submitted that both parties are Gotia and there is land dispute between the parties. Case and counter case. The doctor has found the injuries sustained by the injured simple in nature. Petitioners claim clean antecedents.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist Class, Jhanjharpur, Madhubani in connection with Madhepur P.S.
