JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being father in law of the victim is in jail custody since 27.11.2013 in a case registered for the offences punishable under Sections 498A, 363, 365, 366/34 of the Indian Penal Code.

It would appear from perusal of the case diary that in course of investigation some witnesses stated that victim herself left her matrimonial home and much prior to institution of this case, the petitioner had already given an informatory petition to the aforesaid fact.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the

No.26397 of 2014 (5) dt.09-01-2015 petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Ad hoc Additional Sessions Judge-II, Benipur, Darbhanga in connection with Sessions Trial No. 190 of 2014 arising out of Kusheshwar Asthan P.S. Case No. 196 of 2013.
