2 Petitioner apprehends arrest in a case registered for the offence punishable under sections 323 , 341 , 379, 498A , 506 and 34 of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act.
3 . As per the prosecution case , the marriage of the complainant Lalita Kumari was solemnized with this petitioner on 30.04.2018 . After marriage , she went to her matrimonial house , where this petitioner along with other in -laws subjected her to cruelty and torture for demand of Rs. 2 lakh and a
Patna High Court CR. MISC. No.14755 of 2024(4) dt.20-11-2025 2/3 motorcycle as dowry and ultimately , due to non-fulfillment of the same , she was ousted her from her matrimonial house .
4. Learned counsel appearing for the petitioner submits that petitioner is husband of complainant. Allegation is general and omnibus against him. Petitioner has never tortured complainant for dowry . It is further submitted that petitioner being husband is ready to keep her with full dignity and honour. Petitioner claims clean antecedent.
5 . Mr. Ajay Mukherjee , learned counsel for opposite party no.2 appears and submitted that during pendency of the case Opposite party No. 2 has already been solemnized second marriage and living happily .
6. Considering the aforesaid submission on behalf of opposite party No. 2 , clean antecedent of this petitioner and other circumstances of the case , prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class Banka in Complainant Case No. 106 / 2023, subject to the conditions laid
