The petitioner is languishing in custody since 12.09.2018 in a case registered for the offences punishable under Sections 25(1-b)a and 26 of the Arms Act.
The prosecution case is that from the possession of the petitioner, a country made loaded pistol and cartridges were recovered.
It is submitted by learned counsel for the petitioner that the petitioner has been framed in the present case. A statement has been made in paragraph no.3 of the petition that the petitioner is
Patna High Court Cr.Misc. No.4947 of 2019(2) dt.30-01-2019 2/2 not having any criminal antecedent.
Learned APP for the State submits that the recovery of arms were made from the possession of the petitioner. Considering the fact that the investigation has already been concluded, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M.-I, Patna City in connection with Alamganj P.S. Case No.512 of 2018.
