The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 498(A) of the Indian Penal Code.

It is a case of assault and harassment to the complainant (O.P. No.2) for non-fulfilling the dowry as demanded by her in-laws.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that both parties have filed a petition bearing Matrimonial Suit No. 176 of 2021 for getting their mutual

Patna High Court CR. MISC. No.16353 of 2021(4) dt.08-03-2022 2/2 divorce vide Annexure-3 of the Supplementary Affidavit. He further submits that the petitioner has not committed any offence and they are leaving separately since 01.09.2016. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Pupari, Sitamarhi in connection with Complaint Case No. 35 of 2019 corresponding to Trial No.3470 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
