10-06-2020 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Sugauli P.S. Case No. 391 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 5 liters of country-made liquor is said to have been recovered from the house of the petitioner.

It is submitted on behalf of petitioner that petitioner has falsely been implicated and nothing has been recovered from the possession of the petitioner. It is further submitted that alleged recovery has been made from the house, which is in joint possession and as such, petitioner is not solely responsible. However, from perusal of the material available on record, it appears that recovery has been effected from the house
