Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Complaint Case No. 36(O) of 2020 registered for the offence punishable under Section 30(a) of the Bihar Excise (Amendment) Act, 2018.

This is second attempt by the petitioner for his release on bail. His application was earlier rejected by this Court by an order dated 25.06.2020 passed in Cr. Misc. No. 20900 of 2020. It was observed in the said order that the petitioner shall

Patna High Court CR. MISC. No.16533 of 2021(2) dt.28-07-2021 2/2 be at liberty to renew his prayer for bail after six months, if there was no substantial progress at the trial. Allegedly, 222.480 liters of Indian made foreign liquor was recovered from a pickup van, which was being driven by the petitioner. The petitioner is said to be having no criminal antecedent.

Considering the facts and circumstances and the observation made by this Court in the order dated 25.06.2020 passed in Cr. Misc. No. 20900 of 2020, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Buxar in Complaint Case No. 36(O) of 2020.
