Petitioner is languishing in custody since 10.03.2015 in a case registered for the offences punishable under Sections 20, 21, 22 of the N.D.P.S. Act. Prosecution case is that two vehicles being the Marshal and Honda City were intercepted by the police and from the Marshal 100 bundles of ganja and from the Honda City seven bundles of ganja were recovered. Four persons were found travelling in those vehicles namely Pawan Kumar, Santu Kumar, Manoj Kumar and Santosh Kumar. The apprehended accused that they were working at the behest of the petitioner.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.27344 of 2015 (2) dt.21-07-2015 petitioner that admittedly, recovery has not been made from the possession of the petitioner. Statement has been made in para3 of the petition that petitioner has no criminal antecedent. Moreover, investigation has already concluded. Considering the fact that admittedly recovery has not been made from the possession of the petitioner, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum-Special Judge, Nalanda in connection with Bihar P.S. Case No. 217 of 2013.
