For the Petitioner/s : Mr. Mukul Prasad, Advocate For the Opposite Party/s : Mr. S.D.Singh Yadav (APP) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 09-04-2015 The petitioner and another person, by name Nagina Yadav, are accused of causing the death of Ramabali Sharma. Khizarsarai P.S. Case No.140 of 2011 was registered in relation thereto under Section 302 and other provisions of the I.P.C. The petitioner was arrested on 13.12.2011. Bail application moved by him was rejected by the trial court, whereafter the petitioner moved this Court in Cr.Misc. No.17864 of 2012, which was also dismissed through order dated 29.11.2012. Thereafter this application is filed.

Head learned counsel for the petitioner and the learned A.P.P. for the State.

It is brought to the notice of this Court that another coaccused Nagina Yadav has been granted bail by this Court in

Patna High Court Cr.Misc. No.40670 of 2013 (4) dt.09-04-2015 2/2 Cr.Misc. No.30402 of 2014 through order dated 4.2.2015.The allegation against the petitioner herein is almost similar. Further, the investigation is concluded and the chargesheet is filed. The petitioner is in jail for more than three years. Hence, this application is allowed.

I direct that the petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Ad hoc A.D.J.-III, Gaya, in connection with S.Tr. No.44 of 2012, arising out of Khizarsarai P.S. Case No.140 of 2011.
