The petitioner seeks regular bail in connection with Bhagalpur (Bhagalpur GRPS , NDPS) P.S.Case no.194/19 dated 19.9.2019 registered for offences punishable under Sections 401, 414 of the Indian Penal Code and Section 21b) of NDPS act..

There is recovery of 40 tablets of LOPEZ MZ from the petitioner which is intoxicant. Apart from that he is accused in two other cases.

Submission of the learned counsel for the petitioner is that he has been implicated at the instance of the Police. He is in custody since 20.92019. Charge sheet has already been submitted.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge VI, Bhagalpur in connection with Rail Bhagalpur P.S.Case No.194 of 2019 (Bhagalpur GRPS NDPS 194 of 2019) with condition that he has to appear before the Railway Police Station for the period of six months in the second week of each month so that the Police may watch his conduct. It is also made clear that during that period, if his active involvement is found in other cases, the prosecution is at liberty to move for cancellation of his bail bond.. With the above direction, this application is allowed.
