The petitioner seeks regular bail in connection with Sanhoula P.S. Case No. 146 of 2018 registered for the offence punishable under Sections 384, 386 and 34 of the Indian Penal Code.
The case of the prosecution as per the written report of A.S.I. Makbool Ahmad dated 02.11.2018, submitted to the Station House Officer, Kahalgaon Police Station, is to the effect that on 02.11.2018 at 5 A.M., S.D.O. Kahalgaon informed the informant that some persons were collecting money by way of ransom from the truck drivers at the behest of police personnel whereupon a raid was conducted and the accused persons were
Patna High Court Cr.Misc. No.8203 of 2019(2) dt.13-02-2019 2/2 arrested. As far as the petitioner is concerned, a sum of Rs. 3470/- was recovered.
The learned counsel for the petitioner has submitted that the entire accusation is based on suspicion and the petitioner is having a clean antecedent. It is further submitted that similarly situated co-accused persons have already been granted bail by an order dated 04.02.2019 passed by a coordinate Bench of this Court in Criminal Misc. No. 6002 of 2019. Lastly, it is submitted that the petitioner is languishing in custody since 02.11.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sanhoula P.S. Case No. 146 of 2018.
