2. The petitioner's grievance is that though the post of Executive Engineer was sanctioned and vacant, he has not been promoted since 29.03.2011. It is not the case of the petitioner that anyone junior to him has been promoted or he has suffered any discrimination in the consideration in matter of promotion. The petitioner, therefore, has not made out any right to be promoted on the post which as per his claim was sanctioned and is vacant.

3. Learned counsel for the petitioner, however,

Patna High Court CWJC No.1433 of 2022(3) dt.05-10-2023 2/2 submits that the petitioner will file a representation before the Respondent No. 3 claiming pecuniary benefits/financial progression to which he became entitled on account of stagnation.

4. With such liberty, the writ application is disposed of.
