JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 28.01.2016 in a case registered for the offences punishable under Section 414 of the Indian Penal Code on the accusation that he was caught by the police with stolen motorcycle but submission on behalf of the petitioner is that nothing was recovered from conscious possession of the petitioner and as a matter of fact, petitioner was caught by the police on mere suspicion. Moreover, petitioner was made accused prior to institution of this case in only one case which had been registered under Sections 363, 365/34 of the Indian Penal Code.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact

Patna High Court Cr.Misc. No.16609 of 2016 (2) dt.27-04-2016 2/2 that investigation against the petitioner has already been completed, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Muzaffarpur in connection with Saraiya P.S. Case No. 25 of 2016.
