JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Jokihat P.S. Case No. 211 of 2015, registered under Section 394 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has come in the confessional statement of co-accused Firoz, except the confessional statement, there is nothing against the petitioner to show his involvement in the present case. Further submission is that petitioner is accused in three more cases and due to that reason, Police implicated this petitioner through the confessional

Patna High Court Cr.Misc. No.17720 of 2016 (2) dt.29-04-2016 2/2 statement of co-accused and the petitioner is in custody since 09.01.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Araria in connection with Jokihat P.S. Case No. 211 of 2015. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
