JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 10.03.2015 in a case registered for the offences punishable under Sections 363 and 366a/34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the victim in 164 Cr. P.C. statement, got her age recorded as 15 years when the court also assessed her age as such where she stated that she of her own went in the company of the petitioner and married with him. She also stated that right now, she wants to stay with her parents but after attaining majority she desires to stay with the petitioner. Moreover, the investigation has already concluded.
