JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since24.4.2015 in Bhorey P.S. Case No.111/14 for the offences under Sections 385, 387, 307, 504/34 of the I.P.C., Section 27 of the Arms Act and also Section 3/5 of the Explosive Substance Act. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that the petitioner along with his one associate came to the house of the informant and warned him either to vacate the house or to pay Rs.2/- lacs within 15 days and on his failure of which threatened for dire consequences and on his not doing so on 25.6.2014 they came to the informant and abused him and co-accused opened fire upon him and after hurling bomb they fled away.

No.27143 of 2015 (2) dt.29-07-2015 2/2 It has been submitted on behalf of the petitioner that he is in custody since 24.4.2015 and charge sheet has been submitted in the case. The petitioner has got no criminal antecedent. The main accusation of firing upon the informant is against co-accused, Manindra Mishra.

It has been submitted on behalf of the State that the petitioner is in custody.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri A. Mishra, J.M. 1st Class, Gopalganj, in Bhorey P.S. Case No.111/14.
