JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Petitioner is languishing in custody since 24.04.2015 in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.
It is alleged that petitioner and six others started ploughing the land of the informant through tractor which was objected by the informant when on the order of this petitioner and co-accused Panna Lal Yadav, co-accused Sanjay Mehta dashed the informant by tractor, as a result he fell down then accused persons started assaulting the informant. It is further alleged that co-accused Baijnath Mehta assaulted the informant by means of Dabia.
It is submitted by learned counsel for the petitioner that accusation has been levelled in the background of serious land dispute. The specific overt act has been alleged
Patna High Court Cr.Misc. No.26265 of 2015 (2) dt.27-07-2015 2/2 against Sanjay Mehta and Baijnath Mehta when co-accused Sanjay Mehta has been granted bail vide Cr. Misc. No. 11131 of 2015.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Moreover the investigation has already concluded.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Shankarpur P.S. Case No. 128 of 2014, G.R. No. 2338 of 2014.
