JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 The petitioners apprehend their arrest in connection with Bounsi P.S.Case No. 140 of 2018 registered under Sections 302 and 328/34 of the Indian penal Code.

Allegation against the petitioners, who are in-laws of the deceased, is that deceased had gone to his Sasural and there he was assaulted by the petitioners and other accused persons and they administered poison to him and thrown the dead body in front of the house of the informant.

Submission of learned counsel for the petitioners is that during investigation witnesses have stated in para-18 , 19 and 20 that he himself administered poison and in spite of their best effort he died and the dead body was also found near the house

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Bounsi P.S. Case No. 140 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
