JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-06-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in connection with Sirdala P.S. Case No. 241 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of patrolling duty, informant and other Police personnel received information about preparing the liquor by Gauri Shankar and Babu Chand Manjhi (Petitioners) at four Kilometer away of village-Bhitia, the informant along with other Police personnel reached there. On seeing the Police personnel, both the petitioners fled away

Patna High Court CR. MISC. No.5819 of 2020(2) dt.11-06-2020 2/2 from there taking advantage of bushes. On search, Mahua flower kept in five drums and Gur (Sweet), for the purpose of preparing liquor, recovered.

Learned counsel for the petitioners submits that both the petitioners have no criminal antecedent and they have falsely been implicated in this case mere on suspicion. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J-IIcum-Special Judge, Nawada in connection with Sirdala P.S. Case No. 241 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
