JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Petitioner is languishing in custody since 22.03.2015 in a case registered for the offences punishable under Sections 399/402 of the Indian Penal Code. On information that miscreants are preparing to commit dacoity, raid was laid when six persons including the petitioner were apprehend from a Bolero vehicle. From the vehicle, a red colour three and half feet long cutter with a black colour handle, a pointed iron rod and two mobiles were recovered.

It is submitted by learned counsel for the petitioner that seized articles can not be treated to be recovered from the possession of the petitioner.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Moreover the investigation has already concluded.

No.26620 of 2015 (2) dt.31-07-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 45 of 2015.
