Allegedly, petitioner was caught red handed while he went to the garage of co-accused and asked him to change the engine of Bolero and Santro Car.

The contention on behalf of the petitioner is that as a matter of fact, petitioner runs scrap business and he had purchased the engine of Bolero and Santro Car and subsequently, he sold the engine of Bolero to one Sonelal and, therefore, the accusation of theft is completely falsified.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
