The petitioner seeks bail in Jay Nagar P.S. Case No.581 of 2019 registered for the offence punishable under Sections 272, 273, 414/34 of the Indian Penal Code and Section 30(a)of the Bihar Prohibition and Excise Act. F.I.R as well as seizure list disclosed that recovery 150 bottles of 300 ml each and from a pillion rider 60 bottles of 300 ml. each of illicit liquor were shown from a scooty, by which the petitioner and one Nishant Kumar Yadav were moving.

Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case having no criminal antecedent and he in custody since 09.12.2019. Further submission is that nothing has been recovered from the

Patna High Court CR. MISC. No.5867 of 2020(2) dt.03-02-2020 2/2 conscious possession of the petitioner. The petitioner is only sitting on the vehicle, from which the said liquor was recovered. Heard learned Addl. Public Prosecutor.

Considering nature of allegation, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-cum- Special Judge, Excise Act, Madhubani in connection with Jay Nagar P.S. Case No.581of 2019. (Vinod Kumar Sinha, J) nawalkrs/- U T
