The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on search being conducted 109.5 litres of liquor was recovered from a pick-up van and the petitioner was taken into custody. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He has no concern with the seized liquor nor with the vehicle in question. He is in custody since 11.11.2021 and has no criminal antecedent.

No.5079 of 2022(2) dt.20-04-2022 2/2 Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner, the petitioner having no concern with the pick-up van, having remained in custody for more than 5 months, not having any criminal antecedent and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Spl (Excise) Case no. 1624 of 2017 (arising out of K.Hat (Maranga) P.S. Case no. 393 of 2017) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special (Excise) Judge I, Purnea.
