Admittedly, neither petitioner was caught on the spot nor anything was recovered from his conscious possession and it was co-accused, Sadhu Yadav who disclosed the name of petitioner. Moreover, petitioner is in jail custody since 20.04.2015 and prior to institution of the present case, only one case of Arms Act had been registered against the petitioner.
