JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be first wife of the husband of the deceased and she is not named in the first information report nor any allegation has been leveled against her but from perusal of the impugned order, it would appear that in course of investigation, some witnesses stated the name of the petitioner. Submission on behalf of the petitioner is that the husband of the deceased as well as one co-accused Sadhu Paswan were put on trial in Session trial no. 510 of 2013 and both the aforesaid co-accused were acquitted of the charges. It is further submitted that in view of the aforesaid fact, there is very little chance of conviction of the petitioner, who is languishing in jail

Patna High Court Cr.Misc. No.18665 of 2016 (2) dt.03-05-2016 2/2 custody since 27.10.2015.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Lakhisarai in connection with Medani Chouki P.S.Case No. 12 of 2013.
