The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant named 15 persons in the FIR and alleged that while the informant and others including her husband were returning the accused persons made indiscriminate firing on her husband and her husband died due to gun shot injuries. It is submitted that 15 persons are alleged to have fired but from perusal of the post-mortem report it would appear that Vivek Singh got one firearm injury on his right occipital region and some projectile came out from the left side of the occipital region. Another injury is lacerated wound over left elbow joint.

Patna High Court Cr.Misc. No.28335 of 2015 (2) dt.05-08-2015 2/2 Similarly, situated co-accused Sanjiv Singh has already been enlarged on bail on 23.07.2015 vide orders passed in Cr. Misc. No. 25653 of 2015 and the case of the petitioner stands on same footing.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachia, Bhagalpur in Bihpur P.S. Case No. 18 of 2015.
