The petitioner is languishing in custody since 13.09.2018 in a case registered for the offences punishable under Section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
The prosecution case as per the complaint petition filed by the complainant, Ishrath Praween is to the effect that the complainant was married with the petitioner, Jamal Ansari on
Patna High Court Cr.Misc. No.5298 of 2019(2) dt.31-01-2019 2/3 03.07.2016, subsequently, they were blessed with a female child. Thereafter, demand of further dowry of Rs. 1,00,000/- was made and due to non-fulfillment of the same, torture has been inflicted upon the informant. Moreover, on 30.09.2017, the complainant was brutally assaulted by all the accused persons. It is further alleged that on 15.12.2017, after snatching all the belongings, the complaint was driven out from her matrimonial house.
Learned counsel for the petitioner submits that the petitioner admits his marriage with the complainant and is ready to keep the complainant as wife with full dignity and honour, statement to that effect has been made in paragraph no. 8 of the petition which reads as follows:- "8. That the petitioner is ready to keep his wife with him giving all care and protection."
It is further submitted that the investigation has already been concluded.
Learned APP for the State submits that the thrust of accusation is against the petitioner.
Considering the nature of accusation and the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of
Patna High Court Cr.Misc. No.5298 of 2019(2) dt.31-01-2019 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Gaya, in connection with Complaint Case No.17 of 2018. (Dinesh Kumar Singh, J) Deepak/Rahul/- U T
