The petitioner being the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A and 494 of the Indian Penal Code.
Basic accusation is of torture and performing second marriage.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant and he is ready to keep her as wife with full dignity and honour, a statement to that effect has been made in paragraph 16 of the petition, which reads as under :-
Patna High Court Cr.Misc. No.17739 of 2016 (3) dt.08-08-2016 2/2 "That, it is stated that even after such cruelty done by the complainant, the petitioner is ready to keep the complainant with full dignity and surety....."
It is submitted by learned counsel for the complainant that since the petitioner has performed second marriage the complainant is not ready to resume the conjugal life. Considering the rival submissions of the parties, it is a case for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Trial No.3778/2015 arising out of Complaint Case No.C-1/2112 of 2014, pending before the learned SDJM, Sadar, Sitamarhi.
With the above observation, this application is, accordingly, disposed off.
