JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks bail in connection with Barauni (Garhara OP) P.S. Case No.369 of 2019, registered under Sections 302/34 of the I.P.C and 27 of the Arms Act. As per FIR, the informant along with his brother and other persons went to view the fair on two motorcycles. On the way they found three miscreants on other motorcycle snatched his mobile. The informant and other started chasing. During chasing one of the miscreants fired which hit the brother of informant. The informant took his brother to the hospital where he died.
Submission of learned counsel for the petitioner is that except confessional statement of the co-accused there is nothing at all against in the entire case of prosecution to show

It is submitted that petitioner is accused in two other cases and para 36 of the case diary disclose the identity of the petitioner. In view of the above facts and circumstances, I am not inclined to grant bail in connection with, Barauni (Garhara OP) P.S. Case No.369 of 2019, pending in the court of learned C.J.M., Begusarai. However petitioner shall be at liberty to prove his credence before the learned court below. (Vinod Kumar Sinha, J) SUMIT/- U T
