JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-04-2019 This is an application for grant of anticipatory bail in connection with Manigacchi (Bajitpur O.P.) P.S. Case No. 100 of 2018, disclosing offences under Sections 341, 323, 324, 307, 337 ,379, 427, 504, 34 of the Indian Penal Code. Allegation as per F.I.R. is that while the petitioner along with other co-accused persons were filling the soil, which was objected by the informant, on which the accused persons assaulted the informant and others and specific allegation against this petitioner is that he assaulted one Rajesh Lal Deo by rod on his head causing injury to him.
Submission of learned counsel for the petitioner is that there is counter case also filed by the petitioner's side and no injury report of Rajesh Lal Deo is available on record.

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner and submitted that though the case diary is available till 20.02.2019, but no injury report is available of Rajesh Lal Deo.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Darbhanga, in connection with Manigacchi (Bajitpur O.P.) P.S. Case No. 100 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
