The petitioner apprehends his arrest in connection with Bhore P.S. Case No. 344 of 2019 for the offence registered under Sections 420, 406, 467 and 188 of the Indian Penal Code.

The allegation is regarding the petitioner running an illegal nursing home.

The learned counsel for the petitioner has submitted that a bare perusal of the FIR would show that no offence under Sections 420, 406 and 188 of the Indian Penal Code are made out. It is further submitted that the said nursing home of the petitioner has already been sealed and is no longer in use. Lastly, it is submitted that the petitioner is having a clean

Patna High Court CR. MISC. No.4727 of 2020(2) dt.23-01-2020 2/2 antecedent and has deep roots in the society, hence he is not likely to flee away either from the investigation or the ensuing trial.

Having regard to the facts and circumstances of the case and considering the submissions of the learned counsel for the petitioner, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail. Accordingly, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Bhore P.S. Case No. 344 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
