The petitioner is accused in connection with Economic Offence P.S. Case No. 23 of 2012, registered under Sections 420, 468, 472, 120(B)/34 of the Indian Penal Code. The accusation is that O.M.R. answer sheet and certificate of several candidates including the petitioner were found in rented premises of co-accused Ranjeet Rajak in respect to examination for selection for the post of junior engineer. Learned counsel for the petitioner submits that petitioner has not apprehended on the spot rather it is alleged that certificate and OMR in respect to examination for selection for the post of junior engineer has been recovered from others.

No.19443 of 2016 (2) dt.09-05-2016 2/2 Further submission is that similarly situated co-accused Sanjeev Kumar has already been granted privilege of bail a co-ordinate Bench of this Court on 26.04.2016 passed in Criminal Miscellaneous No. 16593 of 2016. Further submission is that petitioner has no criminal antecedent is in custody since 28.03.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Patna in connection with Economic Offence P.S. Case No. 23 of 2012.
