The petitioner is apprehending his arrest in connection with Babubarhi P.S.Case nO.79 of 2014 (corresponding to G.R.No.1645 of 2014) , registered for offences punishable under Sections 420, 409/34 of the Indian Penal Code. Allegation against the petitioner is that the informant booked 440 bags of wheat for Kolkata through transport agency of the petitioner and that has been sent by Truck No.WB41C/1585. Truck owner was Abul Abdul Quadir and when he inquired about the same from the truck owner and the driver, they threatened him.
Submission of the learned counsel for the petitioner is that the main allegation is against the truck owner and the
Patna High Court CR. MISC. No.6630 of 2019(3) dt.02-04-2019 2/2 driver and he has been falsely implicated in this case. He has already sent the articles that has been not been received. Heard learned A.P.P. , who has opposed the pryar for bail on the ground that the materials has come during the investigation that the petitioner in collusion with the truck driver and the truck owner has misappropriated the whole articles. . Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
With the aforesaid direction, this application is dismissed.
