2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 378, 379, 411,34 of the Indian Penal Code and sections 11/56 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation & Storage) Rules.
3 . As per the prosecution case, petitioner who is driver of the vehicle in question in connivance with other coaccused persons have caused revenue loss of Rs. 22,133/- to the Mining Department.
4. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in this case merely because he happens to be the driver of the alleged vehicle in question . However, owner of the
Patna High Court CR. MISC. No.4953 of 2025(2) dt.04-02-2025 2/2 vehicle in question has already deposited the said amount to the Mining Department.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Barh in Hathidah Police Station Case No. 47 of 2021, subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
