JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of this petitioner came in this case on the basis of information, given by spy of the police and after that, petitioner was remanded and his confessional statement was recorded. It appears that except the aforesaid two materials, there is nothing against him.

No doubt, petitioner carries criminal antecedent of six cases but in the present case, the I.O. could not succeed to collect cogent evidence against the petitioner, except the above-said confessional statement.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten

Patna High Court Cr.Misc. No.27655 of 2015 (4) dt.01-12-2015 2/2 thousand) with two sureties of the like amount each in connection with Siwan Town P.S. Case No. 393 of 2014 to the satisfaction of Chief Judicial Magistrate, Siwan.
