JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 is brother-in law whereas petitioner no.2 is husband of the deceased.
Admittedly, deceased died within one year of her marriage and her dead body was recovered from sugar cane field situated at matrimonial house, the cause of death of the deceased due to asphyxia. Learned counsel for the petitioner submits that parents in -law of the deceased have already been granted privilege of bail by a Co-ordinate Bench of this Court vide order dated 07.07.2014 passed in Cr. Misc. No. 27222 of 2014. Taking note of the above stated submissions as well as
Patna High Court Cr.Misc. No.26992 of 2014 (3) dt.12-01-2015 2/2 this aspect of the matter that petitioner no. 1 is junior member of his family, I think it proper to release him on bail. Accordingly, petitioner no. 1 is directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge V, East Champaran, Motihari in connection with Paharpur P.S.Case No. 237 of 2013. So far as petitioner no. 2 is concerned, his prayer for bail in connection with the aforesaid case stands rejected. (Hemant Kumar Srivastava, J) Namita/- U
