In this case, the petitioner is seeking anticipatory bail in connection with Amdabad P.S. Case No. 166 of 2018, registered for the offence under Sections 341, 354, 325 and 307/34 of the Indian Penal Code.

Allegation has been made that the informant had gone for natural call. While she was returning, the accused persons surrounded her and started teasing and also started touching the different parts of the body. It has also been alleged that they also tried to drag the informant and in that activity her cloth was torn and whereafter co-accused Kabil @ Md. Kabil caused injury by iron rod.

No.5321 of 2019(2) dt.31-01-2019 2/2 Learned counsel for the petitioner submits that thee are case and counter case from both the side and in order to settle the score the present petitioner has been implicated in this case. He further submits that co-accused Kabil @ Md. Kabil has already been granted bail by this Court in Criminal Miscellaneous No.3608 of 2019.

Looking to the entire aforesaid fact and circumstances of the case, let the petitioner, namely, Hamed, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Katihar, in connection with Amdabad P.S. Case no. 166 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
