The petitioner seeks bail in a case registered for the offences punishable under Sections 498(A), 304(B) and other Sections of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act.
The uncle of the deceased Nisha Kumari made allegation that his niece was married to Ajay Kumar 21⁄2 years ago, but her husband and other in-laws were subjecting her to physical and mental torture due to non-fulfillment of the demand of dowry and they killed her. The petitioner is the father-in-law of the deceased.
Submission is that the husband has already surrendered in the court on 04.08.2015 and no specific allegation is made
Patna High Court Cr.Misc. No.27893 of 2015 (2) dt.05-08-2015 2/2 against the petitioner.
On the other hand, learned counsel for the informant as well as learned APP vehemently opposed the prayer for bail. Considering the facts aforesaid and the fact that the petitioner is father-in-law of the deceased and he is in jail since 03.04.2015, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in Aungari P.S. Case No. 27 of 2014.
