However, from perusal of the record, it appears that this miscellaneous appeal has been filed against the order dated 13.06.2017 passed by Additional Sessions Judge-II, Gopalganj in Bishambharpur P.S. Case No. 13 of 2017 whereby the learned Lower Court has disposed of the release petition filed by the appellant for release of his seized motorcycle finding the same not maintainable.

As the impugned order has been passed in criminal matter, hence Civil Miscellaneous Appeal against the said order is not maintainable. The appellant may take recourse of the

Patna High Court MA No.578 of 2017 (3) dt.01-11-2017 2/2 criminal procedure.

In view of the above, this miscellaneous appeal is dismissed as not maintainable.
