The petitioner is accused in connection with Sheosagar P.S. Case No. 17 of 2015, registered under Section 25(1-b)a/26/35 of the Arms Act.

The accusation is that the Police knocked the door of the petitioner then on lady came out from the house having a plastic bag in her hand and started to flee away, but she was apprehended by the Police. On search, one country made pistol along with three live cartridges were recovered from her possession. On query, she disclosed her name as Rita Devi and she also disclosed that she has been brought by this petitioner. Learned counsel for the petitioner submits that it would appear from the F.I.R. that one country made pistol along

Patna High Court Cr.Misc. No.17779 of 2016 (2) dt.02-05-2016 2/2 with three live cartridges were recovered from the possession of Rita Devi, but petitioner was not present in his house, except the confessional statement of co-accused Rita Devi there is nothing against the petitioner to show his involvement in the present case. The petitioner having no criminal antecedent is in custody since 07.02.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.VII, Rohtas, Sasaram in connection with Sheosagar P.S. Case No. 17 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
