The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, on information having been received a raid was conducted and the petitioner who was an absconder in another case was arrested. On information gathered from the petitioner that he had hidden his illegal arms in the house of one Manoj Rai, a raid was conducted and a country-made rifle and two live cartridges was recovered from the house of Manoj Rai and his brother was taken into custody. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his person

Patna High Court CR. MISC. No.17010 of 2021(2) dt.26-08-2021 2/2 or possession. He has been falsely implicated in the case. The alleged recovery is from the house of Manoj Rai. The petitioner is in custody since 16.9.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Barhara P.S. Case no. 312/2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara.
