Heard the learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner apprehends his arrest for the offences alleged under Sections 323, 341, 354(B), 379 and 448/34 of the Indian Penal Code and Sections 8/12 of the POCSO Act as well as as Sections 3(1) (R) (S) and (W) of SC/ST Act, registered in connection with Baniyapur P.S.Case No. 258 of 2020.

As per allegation, the petitioner misbehaved with daughter of the informant. The informant complained to the family members of the petitioner, whereupon Hari Mohan and Lal Mohan Singh assaulted the informant.

The learned counsel for the petitioner has submitted that co-accused Lal Mohan Singh had already lodged Complaint

Patna High Court CR. MISC. No.19896 of 2021(2) dt.24-01-2022 2/2 Case No. 1380 of 2020 which is prior to the present case and only with his intent to make pressure to compromise that case this case has been lodged with ulterior motive. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO, Saran at Chapra in connection with Baniyapur P.S.Case No.258 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
