Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 20-02-2019 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Supaul P.S. Case No. 508 of 2018, registered for the offence under Sections 198, 420, 467, 468, 471, 477(A) and 120B of the Indian Penal Code. Allegation has been made that the petitioner has obtained the employment by fraudulent manner as he has secured 409 marks i.e. 45.44%, but in the select list his percentage of marks has been shown as 70% and his name is at serial no.6 in the select list.

As per the direction of this Court, the petitioner is physically present before this Court. It appears from the

Patna High Court Cr.Misc. No.4197 of 2019(3) dt.20-02-2019 2/2 application form, which the petitioner has filed for his selection, that he has filled up the correct percentage of marks in the application form.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Abhay Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case no. 508 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
